ABSTRACT
This thesis is entitled ANALYSIS OF ARTICLE 11 PARAGRAPHS (1) AND (2) OF CIAMIS REGENT REGULATION NUMBER 13 OF 2018 CONCERNING GUIDELINES FOR THE APPOINTMENT OF ASSISTANT OFFICERS FOR RELIGIOUS AFFAIRS SERVICES IN VILLAGES/URBAN VILLAGES IN CIAMIS REGENCY, by ENTIS SUTISNA, NIM. 82339240007.
In order to prevent governmental stagnation and to optimize public services, particularly in the field of religious affairs at the village/urban village level, officers are needed to assist in religious service activities. This is regulated through Appointment Guidelines for the broader benefit of the community, which gave rise to the issuance of Regent Regulation Number 13 of 2018 concerning Guidelines for the Appointment of Assistant Officers for Religious Affairs Services in Villages/Urban Villages in Ciamis Regency.
The research and writing were conducted using a descriptive design, with data gathered through qualitative methods including observation, semi-structured interviews, and documentation. Data analysis employed reduction, data presentation, and conclusion drawing.
However, in the implementation of Regent Regulation Number 13 of 2018, a deficiency was identified regarding the dismissal procedure for Assistant Marriage Registrar Officers (P3N). A specific case arose involving the dismissal of a P3N by the Head of Mangkubumi Village through Decree Number 16 of 2023.
Upon review of Article 11 Paragraphs (1) and (2), sub-paragraph (e) of Regent Regulation Number 13 of 2018, it was found that there is no clear technical mechanism for dismissal, which has caused problems within the community. Therefore, it is critically important to establish a dismissal mechanism for Assistant Marriage Registrar Officers through the addition of Paragraph (3), as referred to in Paragraph (2) sub-paragraph (e) — namely, acts contrary to religious norms and local customs — which must follow the dismissal procedure below:
Formation of a dismissal hearing committee for the Assistant Marriage Registrar Officer, consisting of: (a) Head of Services Section in the Village / Head of Empowerment Section in the Urban Village; (b) Chairperson of the Village Community Resilience Institution (LPM) in the Urban Village; (c) Chairperson of the Village Consultative Body (BPD) in the Village; (d) Chairperson of the Indonesian Ulema Council (MUI) in the Village/Urban Village; (e) Village Head/Urban Village Head (Lurah).
The outcome of the dismissal hearing shall be documented in official Minutes of Proceedings, followed by the issuance of a Decree by the Village Head/Lurah.If the Assistant Marriage Registrar Officer objects, they may file an administrative remedy in the form of a formal objection to the Regent of Ciamis,The letter of objection must be submitted no later than 30 (thirty) days after the Assistant Marriage Registrar Officer receives the Decree of the Village Head/Lurah.
Should the Assistant Marriage Registrar Officer remain dissatisfied, they may file a lawsuit against the. Decree of the Village Head/Lurah before the State Administrative Court (PTUN), whose primary function is to process claims brought by parties who feel aggrieved by decisions or actions of public officials
