THE URGENCY OF EVALUATING REGIONAL REGULATIONS ON THE PLANNING OF REGIONAL LEGAL PRODUCTS IN CIAMIS REGENCY BASED ON THE PROVISIONS OF THE MINISTER OF HOME AFFAIRS REGULATION NUMBER 80 OF 2015 CONCERNING THE FORMATION OF REGIONAL LEGAL PRODUCTS

Evaluation of Regional Regulations (Perda) is a crucial component of the regional legal product development system to ensure compliance with higher-level laws, the public interest, and the dynamics of community needs. Minister of Home Affairs Regulation Number 80 of 2015 concerning the Development of Regional Legal Products regulates evaluation mechanisms as a preventive control instrument in the regional legislative process. However, in practice, evaluation is often understood as merely an administrative procedure prior to the enactment of a Regional Regulation and has not yet fully functioned as a basis for regional legal product planning through the Regional Regulation Development Program (Propemperda). In Ciamis Regency, regional legislative planning still shows a tendency not to systematically integrate the results of Perda evaluations into the development of Propemperda. This condition has the potential to lead to
overlapping regulations, ineffective implementation, and disharmony of norms within the national legal system. This study aims to: (1) analyze the evaluation of Regional Regulations within the regional legal product formation system based on Ministerial Regulation No. 80 of 2015.
The research method is normative juridical, examining laws and regulations, legal principles, and legal systems related to government procurement of goods and services to ensure orderly construction service delivery through contract law aspects, then analyzing them using various legal theories.
The results of the study indicate that, normatively, Ministerial Regulation No. 80 of 2015 positions evaluation as a mechanism for vertical harmonization and preventive control in the formation of Regional Regulations. However, its regulations still focus on pre-stipulation (ex-ante) evaluation and do not comprehensively regulate post-implementation (ex-post) evaluation. Empirically, the implementation of Regional Regulation evaluation in Ciamis Regency has been carried out according to formal procedures, but has not been optimally integrated into the preparation of Propemperda. Therefore, Regional Regulation evaluation is an urgent factor in ensuring the effectiveness, quality, and harmonization of regional legal product planning. Integrating systematic and evidence-based regulatory evaluation into regional legislative planning is a strategic step to realize good and responsive regional governance.
