ABSTRACT
ANALISIS PUTUSAN MAHKAMAH AGUNG NOMOR: 23.P/HUM/2024 DUHUBUNGKAN DENGAN DENGAN PERSPEKTIF PERATURAN KOMISI PEMILIHAN UMUM NOMOR 9 TAHUN 2020 TENTANG PENCALONAN PEMILIHAN GUBERNUR DAN WAKIL GUBERNUR, BUPATI DAN WAKIL BUPATI, DAN/ATAU WALIKOTA DAN WAKIL WALIKOTA
The request for a judicial review of the regulations under the law handled by the Supreme Court regarding the age limit requirements for regional head candidates in 2024 is directly confronted with the -The 1945 Constitution of the Republic of Indonesia should be aligned with the Law, which is less appropriate and deviates from the authority established by the Law and the 1945 Constitution of the Republic of Indonesia.
Are the legal considerations of the judges, the legal procedures, and the Supreme Court Decision No. 23.P/HUM/2024 regarding the age limit requirements for regional head candidates in the 2024 regional head elections connected to the perspective of Law No. 10 of 2016 on the Establishment of Government Regulations Replacing the Law -Law No. 1 of 2014 on the Election of Governors, Regents, and Mayors into Law has touched on the sense of justice of the community.
The research method used by the author is normative legal research or literature research. This method is carried out by reviewing library materials or secondary data available in libraries. Normative legal research is often associated with legislation and other legal documents. The components of legal norms that can be used as objects in normative legal research include legal principles, basic norms, legislation, regulations of state institutions, court decisions, and all forms of legal documents that are formally established and have binding legal force.
The conclusion of the research on the judge's legal considerations, legal procedures, and the Supreme Court's decision in the material review in Supreme Court Decision Number 23.P/HUM/2024 is not very convincing because it does not consider all the legal facts, does not analyse them in depth, and does not apply rigid legal procedures in handling material reviews.
