Abstract

ABSTRACT ANALYSIS OF TERMINATION OF INVESTIGATION IN CASES OF ALLEGED CRIMINAL ACTIONS OF PORNOGRAPHIC AND INCIDENT CONTENT IN PASIRKIAMIS VILLAGE, PASIRWANGI DISTRICT, GARUT REGENCY (Case Study of Police Report Number: LP/B/91/III/2023/SPKT/POLRES GARUT/POLDA JABAR) TONI BASARUDIN NIM. 82338230017 The Prohibition of Pornography in Indonesia as stipulated in Written Law has been included in the Criminal Code as a legacy from the Dutch East Indies colonialists and has been in effect in Indonesia since 1917, which then became a Law and came into effect after Indonesia's independence based on Law Number 1 of 1946. The articles that regulate and determine the prohibition and punishment for anyone who commits a crime of pornography and pornoaction are Article 281, Article 282, Article 283, Article 532, and Article 533 of the Criminal Code. However, the provisions in the Criminal Code were not effective, so Law Number 44 of 2008 concerning pornography was created. The provisions regarding the crime of pornography are very clear, however, the investigation process for Police Report Number: LP/B/91/III/2023/SPKT/POLRES GARUT/POLDA JABAR was stopped. Therefore, the formulation of the problem is how to handle the alleged criminal act of pornography and immoral content in Pasirkiamis Village, Pasirwangi District, Garut Regency based on Police Report Number: LP/B/91/III/2023/SPKT/POLRES GARUT/POLDA JABAR? and how is the criminal law review in terminating the investigation of the alleged criminal act of pornography and immoral content in Pasirkiamis Village, Pasirwangi District, Garut Regency? The research method is normative juridical by examining laws and regulations, legal principles, legal systematics related to defamation on social media and then analyzed using various legal theories. The results of the study show that First. the process of handling the alleged criminal act of pornography and immoral content in Pasirkiamis Village, Pasirwangi District, Garut Regency Based on Police Report Number: LP/B/91/III/2023/SPKT/POLRES GARUT/POLDA JABAR was stopped in the investigation process. Second. The reported Mr. DANI RAMDANI bin (Alm.) ENDEH was not fulfilled or there was insufficient evidence or the actions of Mr. DANI RAMDANI did not constitute a criminal act, therefore the investigation process was stopped.
