ANALISIS PERTANGGUNG JAWABAN PIDANA MEDIS DALAM TINDAKAN TRANSFUSI DARAH AKIBAT PELIMPAHAN WEWENANG (Studi Kasus Pasien Terkontaminasi Hepatitis Di PMI Kota Banjar)

Abstract

ABSTRACT Health workers who are one of the elements of health resources also have an obligation to carry out their service duties professionally. Blood services are efforts made for health services that utilize human blood as a basic material for treatment for humanitarian purposes without commercial purposes. The blood is obtained from donors who donate their blood and is processed by the Blood Service Unit organized by the PMI (Indonesian Red Cross). The objectives of this study are: (1) To analyze the form of delegation of permission from medical personnel to health workers for blood transfusion actions based on Law No. 17 of 2023 concerning health, (2) To analyze how criminal liability for delegation of permission from medical personnel to health workers for blood transfusion actions resulting in patients being contaminated with hepatitis at the PMI in Banjar City. This study uses a normative legal research method, the research location is at the PMI Blood Transfusion Unit in Banjar City. The results of this study There was carelessness committed by nurses who had performed blood transfusions without conducting a health check through a doctor, resulting in patients being infected with hepatitis at the PMI Blood Transfusion Unit in Banjar City because the authority delegated from doctors to nurses was not in accordance with service standards or standard operating procedures.
